Terms of Service
These general terms and conditions of sale govern every order placed on harajuku-fashion.com. Placing an order constitutes full and unreserved acceptance of them. They prevail over any other document.
1. Identification of the Seller
2. Scope
These terms apply to consumers and to non-professional purchasers. Any professional purchase is subject to prior written agreement. We may amend these terms at any time; the version applicable to an order is the one in force on the date the order is placed.
3. Products
Every item sold on this Site is manufactured to order. No stock is held. Product photographs, mock-ups and colour renderings are illustrative: minor variation in print placement, tone and fabric shade is inherent to made-to-order production and does not constitute a defect or grounds for non-conformity.
All artwork is created in-house. No item reproduces a third-party trademark, character or licensed work.
4. Prices
Prices are expressed in the currency displayed at checkout and are inclusive of delivery. The applicable price is the one displayed at the moment the order is validated. We reserve the right to modify prices at any time, without effect on orders already confirmed.
In the event of a manifest pricing error, we will inform you before dispatch and you may either confirm the order at the corrected price or cancel it at no cost.
5. Ordering Process
The order is formed in the following steps: selection of items, verification of the cart, entry of delivery and billing details, review of the total, acceptance of these terms, and payment. Validation of payment constitutes the double-click confirmation required by Article 1127-2 of the French Civil Code.
The contract is concluded when we send the order confirmation email. We reserve the right to refuse or cancel any order in the event of suspected fraud, an abnormal order, a manifest error, or an inability to fulfil, and will refund any sum already taken.
6. Payment
Payment is due in full at the time of order, through the secure providers listed at checkout. Data is transmitted directly to the provider in encrypted form. Goods remain our property until full payment is received.
7. Delivery
Delivery terms, timeframes, tracking and customs conditions are set out in the Shipping & Delivery page, which forms an integral part of these terms. Indicative timeframes are production of 2 to 5 working days followed by delivery of 3 to 7 working days.
Where delivery has not occurred within 30 days of order confirmation, you may require performance within a reasonable additional period and, failing that, terminate the contract and obtain a full refund, in accordance with Article L216-6 of the French Consumer Code.
Risk of loss transfers to you upon physical delivery of the goods.
8. Right of Withdrawal
Consumers resident in the European Union have 14 days from receipt to withdraw without giving any reason, under Article L221-18 of the French Consumer Code. We voluntarily extend this period to 30 days.
Goods must be returned unworn, unwashed, undamaged and complete. Return costs are borne by you, except where the item is faulty, damaged or not as ordered. Refunds are issued within 14 days of receipt of the returned goods, to the original payment method.
Items made to order are not personalised within the meaning of Article L221-28 3°: the withdrawal right applies in full.
Full conditions are set out in the Refund Policy.
9. Legal Guarantees
Independently of any commercial guarantee, we remain bound by:
- the legal guarantee of conformity, Articles L217-3 and following of the French Consumer Code, for two years from delivery;
- the guarantee against hidden defects, Articles 1641 and following of the French Civil Code, for two years from discovery of the defect.
To invoke either, contact us at the address above. No cost is borne by you for a conforming remedy.
10. Intellectual Property
All artwork, photographs, texts, editorial content, layouts and design elements published on this Site are the exclusive property of DAJE and are protected by French and international intellectual property law. Any reproduction, representation, adaptation or commercial exploitation, in whole or in part, without prior written authorisation is prohibited and constitutes infringement.
Purchase of an item confers ownership of the physical garment only and grants no right whatsoever over the artwork it carries.
11. Liability
Our liability is limited to direct and foreseeable loss and, in any event, to the amount of the order concerned. We are not liable for indirect loss, nor for delays or failures attributable to carriers, customs authorities, payment providers, or to any event of force majeure within the meaning of Article 1218 of the French Civil Code.
Nothing in these terms excludes or limits liability where such exclusion is prohibited by law.
12. Complaints and Dispute Resolution
Any complaint should first be addressed to contact@harajuku-fashion.com. We undertake to reply within 48 working hours.
Failing an amicable resolution, consumers may have recourse free of charge to a consumer mediator, and to the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
13. Personal Data
Processing of personal data is described in the Privacy Policy.
14. Severability and Waiver
If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in full force. Failure to enforce any provision at a given time does not constitute a waiver of it.
15. Governing Law and Jurisdiction
These terms are governed by French law. Disputes fall within the jurisdiction of the competent French courts, without prejudice to the mandatory protective provisions applicable to consumers in their country of residence within the European Union.
